The only better than the excellent food and atmosphere is all the staff who are so friendly and attentive. Alana was our server.... ON GOING POST? CAVAET EMPTOR 11/7/21 In 2019 and January 2020 I left a total deposit of $ 3500.00 at H On The Harbor towards... my daughter?s Bat Mitzvah celebration scheduled for May 2020. Due to the Covid 19 pandemic, H On The Harbor was closed and theevent could not take place. After they reopened I requested that my $3500.00 deposit be returned. They refused to return any ofthe deposit. Just an absolute terrible experience! CAVET EMPTOR PART 2 (edited) 11/11/21 I want to thank the people who havereached out to me publicly and privately showing me support in my initial post entitled CAVAET EMPTOR. Today I?mgoing to discuss H on the Harbors contract. At the time I hired H on the Harbor, I indeed signed their contract dated March22, 2019. As I stated previously in my initial post, this was a happy occasion, celebrating my daughter?s BAT MITZVAH.Unfortunately I did not read the fine print in small letters in the back of the contract. Foolish me! And here?s why I said Iwas foolish. If there?s a dispute, in clause 10 it stipulates that ?the breach thereof shall be decided by Arbitration?etcmeaning the patron(customer)gives up the right to go to court(in my case small claims court). Additionally clause 10 also statesthat the patron(customer) pays all legal and arbitration costs.? I found out that it is customary and only fair for all partiesconcerned in arbitration to split the costs and I believe it is also fair that each side pay their own legal costs. With thatbeing said I interpret clause 10 to effectively make it so OPPRESSIVELY BURDENSOME for the customer to dispute thecontract. I mean I paid H on the Harbor $3500.00 as a down payment, and to bring a cause of action to recover this money inarbitration will cost me more than what I would be seeking back!!! CAVAET EMPTOR 3 (edited) 12/5/21 The purpose of this postis to fill in some details. After I Ieft my initial $2500.00 deposit with H On The Harbor on March 22, 2019 I Read more
